proceeds of crime — money and other property obtained as a result of committing a crime, as well as any profits or income derived from the use of such property; as well as money and other property that has been wholly or partially converted, altered, transformed into other property, or added to property obtained from lawful sources.
legalization of proceeds of crime — a criminally punishable socially dangerous act consisting in giving a legitimate appearance to the origin of funds or other property by transferring, converting, or exchanging them, as well as concealing or disguising their true nature, source, location, method of disposal, movement, genuine rights in relation to funds or other property, or its ownership, if the funds or other property were obtained as a result of criminal activity;
financing terrorism - criminally punishable socially dangerous act aimed at ensuring the existence, functioning, and financing of a terrorist organization, travel abroad or movement through the territory of the Republic of Uzbekistan to participate in terrorist activities, preparation and commission of terrorist acts, direct or indirect provision or collection of any funds, resources, or other services to terrorist organizations or persons facilitating or participating in terrorist activities.
financing the proliferation of weapons of mass destruction — providing or collecting any funds, resources, or other services for the purpose of developing, producing, acquiring, accumulating, storing, distributing, or using nuclear, chemical, biological, or other types of weapons of mass destruction, materials, and equipment that can be knowingly used in their creation.
internal control — activities related to the proper verification of customers, management of the risks of money laundering and terrorist financing, and terrorist financing, identifying questionable and suspicious transactions, as well as transactions involving persons who are involved or suspected of being involved in terrorist activities or the proliferation of weapons of mass destruction;
internal control service — a special unit responsible for internal control;
internal rules — an internal document regulating the organization and implementation of internal control;
specially authorized state body — the Department for Combating Tax, Currency Crimes, and Money Laundering under the General Prosecutor's Office of the Republic of Uzbekistan;
client — a natural or legal person who has applied with an order (application, request) to carry out a transaction with funds or other property (hereinafter referred to as transactions);
potentially suspicious transaction — a transaction in respect of which, during the implementation of internal control, there arose a doubt as to its execution for the purpose of laundering the proceeds of criminal activity and/or financing of terrorism, prior to the decision on whether to classify (or not to classify) it as a suspicious transaction.
suspicious transaction — a transaction that is being prepared, carried out, or has already been completed, in respect of which, during the implementation of internal control, there arose a suspicion regarding its execution for the purpose of laundering the proceeds of criminal activity and/or financing of terrorism.
customer due diligence — verification of the identity and authority of the customer and the persons on whose behalf the customer acts, identification of the customer’s beneficial owner, as well as ongoing monitoring of the customer’s business relationships and transactions in order to ensure their consistency with the information available about such customer and the nature of its activities.
customer identification — determining customer details based on the documents they provide for the purpose of conducting proper customer verification;
offshore zone — states and territories that provide preferential tax treatment and/or do not require the disclosure and submission of information when conducting financial transactions;
risk — the risk of customers conducting transactions for the purpose of laundering proceeds from criminal activity or financing terrorism;
public officials — persons appointed or elected permanently, temporarily, or by special authority, who perform organizational and administrative functions in state bodies and are authorized to perform legally significant actions, as well as persons performing these functions in an international organization or in the legislative, executive, administrative, or judicial bodies of a foreign state;
freezing of funds or other property — prohibition on the transfer, conversion, disposal, or movement of funds or other property;
suspension of operations — suspension of the execution of client orders for the transfer, conversion, transfer of ownership and use of funds or other property to other persons, as well as the performance of other legally significant actions;
List — a list of persons involved or suspected of involvement in terrorist activities or the proliferation of weapons of mass destruction, compiled by a specially authorized state body on the basis of information provided by state bodies engaged in combating terrorism and the proliferation of weapons of mass destruction, and other competent authorities of the Republic of Uzbekistan, as well as information received through official channels from competent authorities of foreign states and international organizations.
third party — organizations specified in Article 12 of the Law of the Republic of Uzbekistan “On Combating the Legalization of Proceeds from Criminal Activity, Terrorism Financing and Financing the Proliferation of Weapons of Mass Destruction,” registered in the Republic of Uzbekistan and carrying out transactions involving funds or other assets.
